ARTICLE 1 — GENERAL PROVISIONS

These General Terms and Conditions of Sale (“Terms”) govern all sales made through the BioDermae™ website, operated by KAGLIA LLC.

By placing an order on the website, the customer acknowledges and agrees to be bound by these Terms.

KAGLIA LLC reserves the right to modify these Terms at any time. The Terms applicable to an order are those in effect at the time the order is placed.

ARTICLE 2 — PRODUCTS

The website offers skincare and cosmetic products under the BioDermae™ brand.

We make every reasonable effort to describe and display our products accurately. However, product images are provided for illustrative purposes, and minor differences in appearance, colour, packaging, labeling, or presentation may occur.

Individual skincare results may vary depending on factors such as skin type, age, routine, frequency of use, and other individual characteristics.

ARTICLE 3 — ORDERS

Orders are placed online through the following process:

• Adding the selected product(s) to the cart
• Reviewing and confirming the order
• Completing secure payment

Creating a customer account is not required to place an order.

The customer is responsible for ensuring that all information provided during checkout, including shipping address and contact details, is complete and accurate.

ARTICLE 4 — ORDER CONFIRMATION

An order is considered confirmed once payment has been successfully authorized and an order confirmation has been issued.

A confirmation email will be sent to the email address provided during checkout.

KAGLIA LLC reserves the right to refuse or cancel an order where reasonably necessary, including in cases of:

If an order is cancelled after payment has been collected, the applicable amount will be refunded in accordance with applicable law.

BioDermae™ does not directly store complete payment card details.

BioDermae™ primarily serves customers in Canada and may also offer shipping to other destinations where available.

Processing and Estimated Delivery Times

Estimated processing time: 24 to 72 hours.

Estimated delivery time: 7 to 12 business days, unless otherwise stated during checkout or elsewhere on the website.

Delivery times are estimates and may vary due to factors including:

• Weather conditions
• Peak shipping periods
• Other circumstances outside our reasonable control

Tracking

When tracking is available, customers will receive tracking information after their order has been shipped.

Eligible BioDermae™ products are covered by our 99-Day Money-Back Guarantee, beginning on the date of delivery.

Customers may reasonably use and evaluate the product during this period.

If BioDermae™ is not suitable for you, you may request a return within the applicable 99-day guarantee period.

Return Conditions

Returned products should, where reasonably possible, be:

• Returned with the original container or packaging
• Securely packaged to prevent damage during transit
• In a condition consistent with reasonable use under the guarantee

Reasonable use necessary to evaluate the product under the 99-Day Money-Back Guarantee does not, by itself, make the product ineligible for return.

Return Shipping Costs

Unless otherwise required by applicable law, return shipping costs are the customer's responsibility for returns based on dissatisfaction or a change of mind.

BioDermae™ will cover reasonable return or replacement costs where:

• The product arrives defective
• The product arrives damaged
• An incorrect product was sent
• The error is attributable to BioDermae™

Return Procedure

Before returning a product, customers must contact our customer support team at info@biodermae.com and provide:

• Their order number
• The reason for the return
• Supporting information or photographs where relevant

Return instructions and the appropriate return address will then be provided.

Products should not be returned before receiving return instructions from our customer support team.

Refunds

Once an eligible return has been received and reviewed, approved refunds are generally processed within 5 business days.

After a refund is issued, additional processing time may be required by the customer's bank or payment provider.

Unless otherwise required by law, refunds will be issued to the original payment method.

BioDermae™ products are cosmetic skincare products and should be used according to the instructions provided.

To the extent permitted by applicable law, KAGLIA LLC shall not be liable for losses or damages resulting from:

• Use contrary to the instructions provided
• Known allergies or sensitivities not reasonably disclosed to us
• Delivery delays caused by circumstances outside our reasonable control
• Incorrect information provided by the customer
• Indirect or consequential losses where such exclusions are permitted by law

If you have a known skin condition, allergy, sensitivity, or are undergoing dermatological treatment, you should consult an appropriate healthcare professional before introducing a new cosmetic product into your routine.

Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited.
